1. Definitions

2. Scope of Services

2.1 We provide rubbish clearance and waste collection services for domestic, commercial and other premises. This may include removal of household waste, garden waste, office waste, bulky items and other non-hazardous materials, subject always to these Terms and Conditions and applicable waste regulations.

2.2 We reserve the right to refuse to collect any waste that is not suitable for collection or disposal under current legislation, that we reasonably consider unsafe to handle, or that falls outside the category of waste agreed at the time of booking.

2.3 We do not normally collect hazardous or specialist waste such as asbestos, certain types of chemicals, oils, clinical waste, gas bottles, pressurised containers, or any other materials classified as hazardous under applicable laws, except where we have explicitly agreed in writing to do so and appropriate arrangements have been made.

3. Booking Process

3.1 You may request a booking by contacting us via telephone, email or our online enquiry channels. All bookings are subject to availability and confirmation by us.

3.2 When making a booking, you must provide accurate and complete information, including the type and approximate volume or weight of waste, the location of the site, access details, any parking restrictions, and any other relevant information that may affect the provision of the services.

3.3 We may provide an estimated quote based on the information you supply. This estimate may be revised if, upon arrival at the site, the nature, type or volume of waste differs from that described, if access is substantially more difficult than indicated, or if additional services are requested.

3.4 A booking is not considered confirmed until we have accepted your request and provided you with confirmation of the scheduled date and time. We reserve the right to decline any booking request at our discretion.

3.5 You are responsible for ensuring that someone with authority is present at the site at the time of the booking to grant access, confirm the waste to be collected and approve any additional charges where applicable.

4. Access and Parking

4.1 You must ensure that we have safe, reasonable and unhindered access to the site and to the waste to be collected at the agreed time. This includes providing accurate information in advance regarding access routes, stairs, lifts, security gates, restricted areas and any other factors that may affect our ability to carry out the services.

4.2 You are responsible for arranging any necessary parking permits, visitor permissions, entry codes or other authorisations required for our vehicles and staff to access the site and carry out the services without delay.

4.3 If suitable parking is not available or access is obstructed, delayed or prevented for reasons beyond our control, we may at our discretion either charge a waiting fee, reschedule the booking and charge a call-out fee, or cancel the booking and charge a cancellation fee in accordance with these Terms and Conditions.

5. Pricing and Quotes

5.1 Our charges are usually based on factors such as the volume of waste, weight, loading time, access conditions and type of materials. We may provide price lists, ranges or guide prices, but the final price will be confirmed on site before the work is carried out wherever possible.

5.2 Any quote given prior to our arrival at the site is an estimate based on the information provided by you. If the actual waste or conditions differ from that information, we are entitled to revise the price accordingly. You will be informed of any change in price before work proceeds.

5.3 Where we have to incur additional costs, such as congestion charges, parking charges, restricted access surcharges, or fees associated with certain waste streams, these may be added to the final invoice.

6. Payments

6.1 Payment is due in full on completion of the services, unless we have agreed alternative payment terms in writing in advance. We accept payment by cash, card or other methods as specified by us from time to time.

6.2 For business customers, we may at our discretion agree to provide services on account. In such cases, payment terms will usually be set out on the invoice. Unless otherwise stated, payment is due within 14 days of the invoice date.

6.3 If payment is not received by the due date, we reserve the right to charge interest on overdue amounts at the statutory rate permitted under applicable law, as well as reasonable administration and recovery costs.

6.4 You are responsible for paying any applicable taxes, including value added tax, that may be chargeable on the services.

6.5 Ownership of any waste does not transfer to us until payment for the services has been received in full, subject to applicable waste transfer and duty of care regulations.

7. Cancellations and Amendments

7.1 You may cancel or amend a booking by giving us as much notice as reasonably possible. Cancellations or significant changes made less than 24 hours before the scheduled time may be subject to a cancellation fee.

7.2 If you cancel on arrival or after our team has already attended the site, we reserve the right to charge a call-out fee and any reasonable costs incurred.

7.3 We will make reasonable efforts to accommodate changes to bookings relating to time, date, site address or scope of work. However, we are not obliged to accept changes and may treat major changes as a cancellation and new booking.

7.4 We may cancel or reschedule a booking due to circumstances beyond our control, such as severe weather, traffic disruption, vehicle breakdown, staff illness, safety concerns or changes in legal requirements. In such cases, we will endeavour to inform you as soon as reasonably possible and arrange a new appointment. We will not be liable for any costs or losses resulting from such cancellation or delay, save as required by law.

8. Your Responsibilities

8.1 You must ensure that all waste to be removed is clearly identified and accessible, and that it belongs to you or that you have the authority to request its removal.

8.2 You must not include in the waste any hazardous or prohibited materials that you have not previously disclosed to us and that we have not agreed to collect.

8.3 You must ensure that the site is reasonably safe for our staff to work in, including taking steps to minimise risks arising from pets, children, other occupants, obstacles, trip hazards, unstable items and dangerous materials.

8.4 You must comply with all relevant laws and regulations applicable to your use of our services and your management of waste, including your duty of care as a waste producer under UK law.

9. Waste Handling and Regulations

9.1 We operate in accordance with applicable UK waste management laws and regulations. This includes holding appropriate licences or registrations where required for the collection, transport and disposal of controlled waste.

9.2 We will take reasonable steps to ensure that collected waste is handled, transported and disposed of in a lawful and environmentally responsible manner, including the use of licensed waste transfer facilities and recycling facilities where appropriate.

9.3 We may issue waste transfer notes or other documentation where required by law or requested by you, and you agree to retain such documents as part of your statutory duty of care.

9.4 We reserve the right to refuse or remove from our vehicle any materials that we reasonably suspect to be hazardous, explosive, illegal or otherwise inappropriate for collection or disposal.

10. Liability

10.1 We will exercise reasonable care and skill when providing the services. However, you acknowledge that rubbish clearance and waste collection may involve movement of bulky items, working in confined spaces and other activities that carry inherent risks.

10.2 We will not be liable for any pre-existing damage to the site, fixtures, fittings or items, or for any damage that results from defects, weaknesses or pre-existing conditions at the site or in items being moved or removed.

10.3 Our liability for any loss or damage arising from our negligence or breach of these Terms and Conditions shall, to the fullest extent permitted by law, be limited to the total price paid or payable for the specific services giving rise to the claim.

10.4 We shall not be liable for any indirect or consequential losses, including loss of profit, loss of business, loss of opportunity or loss of goodwill, except where such limitation is not permitted by law.

10.5 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

11. Insurance

11.1 We maintain appropriate insurance cover in respect of our legal liabilities arising from the provision of the services. Details of our insurance can be provided on request.

11.2 It is your responsibility to maintain adequate insurance for your own property and contents. We recommend that you check your policies to ensure that you are properly protected in respect of any potential losses not covered by our liability.

12. Complaints

12.1 If you are dissatisfied with any aspect of our services, you should notify us as soon as possible, providing full details of the issue and any supporting information.

12.2 We will investigate complaints in a fair and timely manner and will endeavour to reach a resolution with you. Where appropriate, we may offer to rectify any problem, provide a partial refund or take other remedial action at our discretion.

12.3 Making a complaint does not entitle you to withhold payment for services properly provided, unless we agree otherwise in writing or as required by law.

16. Severability

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed severed and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

17.1 These Terms and Conditions, together with any written quotation or order confirmation provided by us, constitute the entire agreement between you and us in relation to the services and supersede any prior understandings, agreements or representations, whether oral or written.

18. Governing Law and Jurisdiction

18.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.

18.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided.
